Important Legal Notice

BY USING BeamGo, YOU AGREE TO THESE TERMS. THESE TERMS INCLUDE LIMITATIONS OF LIABILITY, INDEMNIFICATION OBLIGATIONS, AND ARBITRATION REQUIREMENTS. PLEASE READ CAREFULLY.

1. Acceptance of Terms

By accessing or using BeamGo ("Service"), you agree to be bound by these Terms of Service ("Terms") and all applicable laws and regulations. If you do not agree with any part of these terms, you are prohibited from using the Service.

You must be at least 18 years old to use this Service. By using the Service, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms.

2. Service Description

BeamGo provides AI-powered video generation services, including:

Text-to-video generation
Image-to-video generation
API access for developers
Credit-based usage system

NO GUARANTEE OF AVAILABILITY: The Service is provided on an "as available" basis. We do not guarantee uninterrupted access or any specific level of availability. We reserve the right to modify, suspend, or discontinue the Service at any time without notice.

3. User Accounts

Account Security: You are responsible for:

Maintaining the confidentiality of your account credentials
All activities that occur under your account
Immediately notifying us of any unauthorized use

Account Restrictions:

One person or legal entity per account
No account sharing or transfer
No automated account creation
We reserve the right to terminate accounts that violate these terms

4. Prohibited Uses

You agree NOT to use the Service to create, upload, or distribute content that:

•Is illegal, harmful, threatening, abusive, harassing, defamatory, or violates any laws
•Contains explicit sexual content, nudity, or pornography
•Depicts violence, gore, or promotes self-harm
•Creates deepfakes for harassment, fraud, or deception
•Infringes on intellectual property rights, including copyrights and trademarks
•Contains malware, viruses, or is designed to harm systems
•Violates the privacy or publicity rights of any person
•Impersonates any person or entity without permission

VIOLATION OF THESE RULES WILL RESULT IN IMMEDIATE ACCOUNT TERMINATION WITHOUT REFUND.

5. Intellectual Property Rights

Your Content

You retain all rights to the content you upload ("Input Content"). By using the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, process, and store your Input Content solely for the purpose of providing the Service.

Generated Content

Subject to our rights below, you own the videos generated using the Service ("Output Content"). You are solely responsible for your use of Output Content and compliance with all applicable laws.

Our Rights

We retain all rights to our Service, including our AI models, software, designs, and trademarks. We may use aggregated, anonymized data to improve our Service.

Important: You represent and warrant that you have all necessary rights to your Input Content and that your use does not infringe on any third-party rights.

6. Payment Terms, Credits & Billing

Pricing and Credits System

All prices are displayed and charged in Euros (€)
For international customers, prices may be shown in your local currency for reference, but all transactions are processed in EUR at the current exchange rate
All prices are subject to applicable taxes (VAT where applicable)
Credits are non-transferable, non-refundable, and have no cash value
Monthly credits reset each billing period and do not roll over
Purchased credits (if applicable) expire after 30 days from purchase date
Credits are consumed in order: monthly credits first, then purchased credits
Credit costs per service are subject to change at our discretion

Subscription Billing & Proration

All subscription payments are processed through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis.

Monthly Renewals (Same Plan):

Credits reset to your plan's monthly allowance at each renewal
Unused credits from the previous month do NOT carry over
Example: If you have 200 credits left on Basic when your subscription renews, you receive 1,000 fresh credits (not 1,200)

Plan Upgrades (Changing to Higher Tier):

When upgrading during your billing cycle (e.g., Basic to Pro), you are charged a prorated amount for the remainder of the current period
Your credit allocation is calculated proportionally based on the total amount paid, including your original plan payment and the prorated upgrade charge
Unused credits from your previous plan tier are factored into this calculation to ensure you receive fair value
This proportional calculation applies ONLY to plan upgrades, not to monthly renewals of the same plan

Plan Downgrades (Changing to Lower Tier):

Downgrades take effect at the end of your current billing period
You retain your current plan benefits and credits until that time
No prorated refunds are provided

Refund Policy

ALL SALES ARE FINAL. NO REFUNDS OR CREDITS TOWARD FUTURE PURCHASES.

Once a payment is processed, it is non-refundable under any circumstances, including but not limited to:

Used or unused credits or subscription periods
Dissatisfaction with generated content quality or results
Service interruptions, downtime, or technical issues
Account termination due to Terms violation
Voluntary cancellation or downgrade of subscription
Changes in pricing or plan features

Proration charges for upgrades are considered service credits applied to your account, not refundable payments. All amounts paid are deemed earned upon payment.

Subscription Auto-Renewal

Subscriptions automatically renew at the end of each billing period unless cancelled
You are solely responsible for cancelling your subscription before the renewal date
Cancellation does not entitle you to any refund for the current billing period
Upon cancellation, you retain access to paid features until the end of the current billing period
Failed payments may result in immediate account downgrade or suspension

Payment Disputes

If you dispute a charge with your payment provider (chargeback), we reserve the right to immediately suspend or terminate your account and pursue collection of the disputed amount plus any associated fees. Fraudulent chargebacks may result in permanent account termination and legal action.

Price Changes: We reserve the right to modify our pricing and credit allocations at any time with 30 days advance notice. Price changes will not affect existing subscriptions until their next renewal period.

7. DISCLAIMERS AND LIMITATION OF LIABILITY

Service Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Limitation of Liability

IN NO EVENT SHALL BeamGo, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, USE, OR GOODWILL.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS OR $100, WHICHEVER IS LESS.

Some jurisdictions do not allow limitation of liability, so these limitations may not apply to you.

8. Indemnification

You agree to indemnify, defend, and hold harmless BeamGo, its affiliates, officers, directors, employees, agents, and licensors from and against all claims, liabilities, damages, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

Your use of the Service
Your violation of these Terms
Your violation of any rights of another party
Your Input Content or Output Content
Any claim that your content caused damage to a third party

9. Termination

Termination by You

You may terminate your account at any time through your account settings. Termination does not entitle you to any refunds.

Termination by Us

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including:

Breach of these Terms
Fraudulent or illegal activity
Non-payment
Prolonged inactivity

Effect of Termination

Upon termination:

Your access to the Service will cease immediately
All credits will be forfeited
We may delete your content and data
All provisions that should survive termination will remain in effect

10. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of [Your Jurisdiction], without regard to its conflict of law provisions.

Arbitration Agreement: Any dispute arising from these Terms shall be resolved through binding arbitration in accordance with the rules of [Arbitration Organization]. The arbitration shall be conducted in [Location], and judgment on the award may be entered in any court having jurisdiction.

Severability

If any provision is found unenforceable, the remaining provisions will continue in full force.

Waiver

No waiver of any term shall be deemed a further or continuing waiver of such term or any other term.
